TERMS OF USE OF 3DSOC WAP SITE

Welcome to the 3DSoC WAP Site (“WAP Site”) to avail the software and content services (“Mobile Services”) provided by 3D Solid Compression Private Limited (“We” or “3DSoC”).

PLEASE READ THE TERMS OF USE CAREFULLY. BY USING OR REGISTERING FOR THE USE OF THE MOBILE SERVICES, YOU ACCEPT THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF USE (“TERMS OF USE”).

The Mobile Services, including the information, facilities, services and content are provided on an “as is” “as available” and “with all faults” basis. We disclaim all express or implied conditions of any kind, including any implied warranty with regard to any and all aspects of the Mobile Services. We make no representations, warranties, quality, sustainability, accuracy or completeness of the Mobile Services as maybe accessed through the Carrier Network and we assume no liability whatsoever arising from the Mobile Services in the nature of defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information/content relating to the Mobile Services. You agree that you may from time to time send messages and/or greetings to others on their mobile phone. 3DSoC will not be liable for any such messages irrespective of the fact that the recipients are registered with the National Do Not Call Registry (“NDNCR”). Further, you agree not to misuse the Mobile Services in any way that may hamper the interests of 3DSoC.

Further we will not be liable to you or any third party for indirect, special, incidental, consequential or exemplary damages.

We reserve the right to correct any errors or omissions in any portion of the Mobile Services and/or make any other changes to the WAP Site and the Mobile Services with respect to but not limited to the functionality, materials / contents, products, programs, services or prices (if any) relating to the WAP Site and the Mobile Services.

Other than as specified herein, you may not modify, adapt or create derivative works from the Mobile Services in any way or remove proprietary notices in the Mobile Services. Your right to modify/alter the content or information of the Mobile Services shall be limited to the text portion of the Services, which limitation may extend to other Mobile Services (like pictures etc.) provided by 3DSoC and which may be notified to you from time to time.

You are prohibited from posting/transmitting/modifying on/through the WAP Site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

You will not violate any laws while using the Mobile Services or violate the rights of other users of 3DSoC or use the WAP Site to send spam. You are responsible for all activities on your account.

You specifically agree to indemnify and keep 3DSoC, its affiliates and their officers, directors, employees, agents, partners, etc. indemnified at all times from all losses, damages, costs, expenses, loss of profits, loss of business, proceedings, actions, suits (including legal fees) as a direct or indirect consequence of your use of the Mobile Services.

Your registration with 3DSoC for the Mobile Services requires you to provide 3DSoC with some personal information, e.g. your phone number.  3DSoC warrants that such personal information will not be used for any other purpose other than for the purpose of providing you the Mobile Services. 3DSoC further warrants that 3DSoC shall use all reasonable methods to protect the personal information and shall provide the personal information to such persons who have a need to know.

Your use of the Mobile Services is also governed by the 3DSoC terms of use of website at URL <http://www.3dsoc.com/termsandconditions.html> and its privacy policy at URL <http://www.3dsoc.com/privacypolicy.html> which may be changed at any time by 3DSoC. You are responsible for checking these terms periodically for changes. Your ongoing use of the Mobile Services after the changes take effect signifies your agreement to the new terms.

The Terms of Use shall be governed and construed in accordance with the laws of India (without regard to the conflict of laws or provisions thereof).
